Terms of Service

1. Acceptance of Terms

By accessing or using Kuar.ai (the "Service"), including our web application at app.kuar.ai, you agree to these Terms of Service. If you do not agree, do not use the Service.

These Terms apply to business users who register for our platform. End customers who message businesses through WhatsApp or Instagram are subject to the privacy practices of the business they contact; Kuar acts as a technology provider to those businesses.

2. Description of Service

Kuar.ai provides a B2B SaaS platform for AI-powered customer communication across messaging channels, including WhatsApp Business API and Instagram Messaging API (Meta Platforms, Inc.). Features include unified inbox, AI agents, automations, CRM, and analytics.

3. Meta Platform and Third-Party Services

Use of WhatsApp and Instagram features requires connection to Meta Platform services. By connecting these channels, you agree to Meta Platform Terms (developers.facebook.com/terms), WhatsApp Business Terms, and Instagram Platform policies.

You are responsible for obtaining any required permissions from your customers and complying with applicable messaging, marketing, and data-protection laws when using our Service with Meta channels.

We use Meta Embedded Signup and Instagram Business Login solely to connect business accounts you authorize. We do not use Facebook Login for consumer authentication to Kuar.

We may integrate with other third-party services (e.g., Google Calendar, payment processors). Your use of those integrations is subject to their respective terms.

4. Account Registration and Security

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account and for actions taken by team members you invite.

You must notify us promptly at support@kuar.ai of any unauthorized access.

5. Acceptable Use

You may not use the Service to send spam, unlawful content, harassing messages, or content that violates Meta or WhatsApp commerce policies.

You may not attempt to reverse engineer, scrape, or misuse Platform Data obtained through Meta APIs.

You may not use the Service for any purpose prohibited by applicable law or third-party platform policies.

6. Your Content and Data

You retain ownership of content and customer data you submit through the Service. You grant Kuar a limited license to process that content solely to provide and improve the Service on your behalf.

You represent that you have the rights and consents necessary to process customer data through our platform, including data received via WhatsApp and Instagram.

7. Subscriptions and Billing

Paid plans are billed according to the pricing selected at signup or upgrade. Fees are non-refundable except as required by law or stated in your order.

We may change pricing with reasonable notice. Continued use after a price change constitutes acceptance.

8. Termination

You may stop using the Service and request account deletion by contacting support@kuar.ai or privacy@kuar.ai. See our Data Deletion Instructions: https://kuar.ai/data-deletion

We may suspend or terminate access if you violate these Terms, Meta policies, or applicable law. Upon termination, your right to use the Service ends; data retention and deletion are described in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted availability of third-party platforms (including Meta, WhatsApp, or Instagram).

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUAR AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability for claims arising from the Service shall not exceed the fees paid by you in the twelve months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
